Terms of Use
1) Acceptance of Terms
By downloading, accessing, or using the App, you agree to these Terms of Use (“Terms”). If you do not agree, do not use the App.
2) The App and eligibility
The App provides focus tools such as ambient noise playback and Pomodoro timers. You must comply with applicable laws and the rules of the App Store through which you obtained the App.
3) License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms and any applicable App Store rules.
4) Restrictions
- You may not reverse engineer, decompile, or attempt to derive source code except where permitted by law.
- You may not misuse the App, interfere with its normal operation, or attempt unauthorized access to any related systems.
- You may not distribute, sell, lease, or sublicense the App.
5) Subscriptions and payments
Some features may require a paid subscription (“Pro”). Purchases are processed by Apple via in-app purchases. Pricing, billing cycle, and renewal terms are shown in the App and in your App Store subscription settings.
- Auto-renewal: Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.
- Manage/cancel: You can manage or cancel your subscription in your Apple ID / App Store account settings.
- Refunds: Refund requests are handled by Apple according to App Store policies.
6) Health & safety disclaimer
The App is provided for general informational and wellness purposes only and is not medical advice. If you have a medical condition (including ADHD, anxiety, sleep disorders, or hearing issues), consult a qualified professional. Use audio responsibly and keep volume at safe levels.
7) Availability and changes
We may change, suspend, or discontinue the App (or parts of it) at any time. We may also update these Terms. Continued use after changes means you accept the updated Terms.
8) Intellectual property
The App and its content (including design, UI, and audio logic) are owned by the provider or its licensors and are protected by applicable laws.
9) Disclaimer of warranties
The App is provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by law. We do not guarantee uninterrupted or error-free operation.
10) Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill arising from your use of the App. Nothing in these Terms limits liability where such limitation is not permitted by law.
11) Termination
These Terms remain effective until terminated. You may stop using the App at any time by uninstalling it. We may terminate or restrict access if you materially breach these Terms.
12) Governing law and jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany. Where permitted, the courts with jurisdiction at the provider’s place of residence shall have exclusive jurisdiction. Mandatory consumer protection laws in your country of residence remain unaffected.
